Smoking in Outdoor Restaurant Patios is Illegal in L.A.

1. This law applies to restaurants, cafes, food courts,food trucks, coffee shops, kiosks and food carts.
2. The law went into effect on March 8, 2011.
3. Smoking within 10 feet of outdoor dining areas at restaurants, cafes, food courts etc is prohibited. Smoking within 40 feet of food kiosks, food carts, food trucks etc is prohibited.
4. The penalty for businesses that don’t comply is up to $500 per infraction.
5. The only exception to this ban is for bars, 18 and older nightclubs/restaurants and businesses or non commercial buildings that host private events that are not open to the public.
6. The law protects others from secondhand smoke, reduces places where children can learn to smoke and makes it easier for smokers who are trying to quit smoking by not exposing them to other smokers.
7. 87.5% of the residents of Los Angeles do not smoke. This law provides the majority of the people with the right to breathe cleaner air.
8. Just to be clear, it is also illegal to smoke inside of any restaurant or public building in L.A., including bars and nightclubs.
9. Businesses are required to post permanent signs using the “NO SMOKING” phrase and/or symbol that includes the 10ft or 40ft distance.
